Terms and Conditions of Use



Kennedy Krieger Institute (KKI) MyChart (“MyChart”) is an internet application that (1) provides secure web-based access to information from the medical record maintained by Kennedy Krieger Institute health care providers (collectively referred to as KKI) in electronic format, (2) provides the ability to pay for services; and (3) provides a secure mechanism to communicate with providers. KKI is offering this service to have a convenient means of reviewing information from the medical record, communicating with KKI health care providers, arranging for clinical services/appointments, and paying for services rendered

The electronic and accessible nature of medical record information maintained on MyChart presents unique security and privacy issues as addressed below. Therefore, certain necessary measures for protecting the security and privacy of such information are the responsibility of the user as detailed below. By requesting a MyChart account and continuing to use MyChart, you are agreeing to these Terms of Service, which include legal and privacy waivers, disclaimers, and personal responsibility requirements.

The information from your medical record available through MyChart will not constitute your entire medical record. The scope of medical record information accessible through MyChart is determined at the discretion of Kennedy Krieger. You will continue to have access to your complete medical record by contacting Kennedy Krieger’s Health Information Management Department directly. THEREFORE, YOU ACKNOWLEDGE THAT MYCHART SHALL NOT BE USED TO MAKE HEALTHCARE DECISIONS OR DIAGNOSIS AND KENNEDY KRIEGER SHALL NOT BE LIABLE FOR ANY PERSONAL INJURY, INCLUDING DEATH, ARISING FROM YOUR USE OR MISUSE OF MYCHART OR ANY INFORMATION OR CONTENT THEREIN. Remedies under these Terms of Service are sole and exclusive and are limited to those expressly provided in these Terms of Service.

You are not required to utilize Kennedy Krieger Institute’s MyChart and may discontinue usage at any time. You acknowledge that Kennedy Krieger Institute’s MyChart is being provided to you without charge. Therefore, Kennedy Krieger reserves the right to terminate your access to Kennedy Krieger Institute’s MyChart at any time, with or without cause. Should Kennedy Krieger determine that you have violated these Terms and Conditions, as may be modified from time to time, Kennedy Krieger may discontinue your usage of Kennedy Krieger Institute’s MyChart immediately, without providing prior notice. In addition, Kennedy Krieger Institute’s MyChart may not be available at all times due to system maintenance, outages, or other issues beyond the control of Kennedy Krieger. BY USING THIS SERVICE OR CLICKING “ACCEPT” BELOW, YOU SIGNIFY YOUR AGREEMENT TO TEHSE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, DO NOT USE THIS SERVICE.

MyChart enables you to send requests, questions and other communications, regarding your medical record information electronically to your health care providers. Such communications will be routed to an appropriate individual within your health care provider’s department. Therefore, individuals other than your personal health care provider may review your medical record information as required to address your request. If your communication contains sensitive information that you want shared only with your personal health care provider, you should contact such provider directly and not through MyChart.


The average turnaround time for responding to requests for information submitted through MyChart is two to three business days. Therefore, communications via MyChart for urgent matters is not appropriate if a quicker response time is needed. In those circumstances, contact your personal health care provider directly. In emergency situations, please dial 911.

Communication from your health care providers via MyChart will contain important information regarding your health care. It is also possible your health care providers may decide not to communicate such information by other means if communicated through MyChart. Therefore, it is important for you to monitor regularly your message inbox in MyChart and your personal e-mail for message notifications. You agree that you will not hold Kennedy Krieger liable for loss, injury or claims resulting from your failure to read messages in a timely manner.

You will be notified via e-mail when there is new medical information to be viewed in MyChart. Notifications may include, but are not limited to, provider messages, test results, prescription renewals, letters, questionnaires, after visit summaries, appointment status and reminders. Any person with access to your email will be able to see this notification. This could include your spouse, employer, or anyone else that can access your email account. Although no private medical information will be sent, the notification that new medical information is available by accessing MyChart may be information that you would not want others to know. You should take this into account when providing an email address and when sharing any information required to access your personal email account. By accepting these Terms of Use and continuing to use this site, you agree to receive communications by email.

Security Considerations



Information from your medical record that is accessible though MyChart is intended for your access only (subject to the discussion below under “Proxy Access”). You will have a unique username and password for MyChart which will provide you with such access and which are crucial to protecting the security of such medical record information. Therefore, such information should not be shared with anyone. In the event you believe your password or username has been compromised, you may change them anytime through MyChart.

Kennedy Krieger will utilize certain security measures within the scope of MyChart such as verification of identity through the use of specific activation codes. However, once you access your medical information through MyChart, you are solely responsible for maintaining the security of such information on your end as well as the information required to access such information (i.e., username and password) Specifically, you are responsible for the results or consequences of your communication regarding, or the sharing of, information accessed via MyChart.

Minors

In general, only individuals aged 18 and older are able to access information via MyChart. Exceptions to that will be made on a case-by-case basis.

Proxy Access

Request by Someone Other Than Patient

Individuals age 18 or older may request proxy access to another individual’s MyChart record. Such access will be granted only to parties with parental rights or legal guardianship over the MyChart record and only to the extent that the party requesting proxy access can demonstrate the legal right to that medical information. Except in the case of parents, only one person will be granted proxy access to a MyChart record through this process. If the proxy’s legal relationship with the patient changes, the proxy must inform Kennedy Krieger immediately by contacting the MyChart Help Desk. Kennedy Krieger reserves the right to revoke proxy access at any time for any reason.

Proxy access may be requested while at your Kennedy Krieger provider’s office by completing the Request for Access to Kennedy Krieger Institute’s MyChart Account by Legal Representative Form, as appropriate. Parents, legal guardians or legal representatives must submit the Request for Access to Kennedy Krieger Institute MyChart Account by Legal Representative Form, along with copies of supporting legal documentation to your Kennedy Krieger provider’s office.

Request by the Patient

A patient may authorize other users of this website to view his/her medical records by completing and submitting to the appropriate Kennedy Krieger representative a Kennedy Krieger Institute MyChart Authorization for Release of Health Information form while at your Kennedy Krieger provider’s office.

Revisions/Changes

Kennedy Krieger may revise the information on this website or otherwise change or update the website, including these Terms of Use, without notice to you. You are encouraged periodically to read these Terms of Use to see if there have been any changes that may affect you. Your continued use of the website will signify your continued agreement to these Terms of Use as they may be revised.

Disclaimer of Liability

KENNEDY KRIEGER EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES CONCERNING MYCHART AND ITS USE BY YOU, AND PROVIDES THE SAME ONLY ON AN “AS IS” AND “AS AVAILABLE” BASIS, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, TITLE, NON-INFRINGEMENT AND/OR FITNESS FOR ANY PURPOSE, AND WARRANTIES OF PERFORMANCE, AND ANY WARRANTY THAT MIGHT OTHERWISE ARISE FROM COURSE OF DEALING OR USAGE OF TRADE. Under no circumstances shall Kennedy Krieger be liable for incidental, special, indirect, direct or consequential damages or loss of profits, interruption of business, or related expense which may arise from your use of or inability to use MyChart and other services provided hereunder, including, but not limited to, those resulting from defects in software, communication lines, virtual private networks, the internet, or your internet service provider, access system computer hardware or software or other service or device that is used to access MyChart and/or documentation, or loss or inaccuracy of data of any kind, whether based on warranty, contrast, tort, or any other legal theory, and whether or Kennedy Krieger is advised of the possibility of such damages.

IN ADDITION, KENNEDY KRIEGER DOES NOT GUARANTEE THAT USE OF MYCHART WILL BE FREE FROM UNAVAILABILITY OF INFORMATION, DOWNTIME, SERVICE DISRUPTIONS, INTENTIONAL OR INADVERTENT INTRUSIONS, VIRUSES OR WORMS OR OTHER MECHANISMS THAT MAY ATTACK YOUR COMPUTER. YOU ACKNOWLEDGE THAT YOU ARE SOLEY RESPONSIBLE FOR ENSURING THAT YOUR COMPUETER HAS ADEQUATE PROTECTIONS AGAINST ANY OF THE FOREGOING. IN ADDITION, YOU ACKNOWLEDGE THAT YOUR INFORMATION WILL BE TRANSMITTED OVER THE INTERNET AND THAT THERE IS NO GUARANTEE OF ACCURACY OR SECURITY.

THE MARYLAND UNIFORM COMPUTER INFORMATION TRANSACTIONS ACT OR ANY VERSION THEREOF, (“MUCITA”) SHALL NOT APPLY TO THIS AGREEMENT AND, TO THE EXTENT THAT MUCITA IS APPLICABLE, THE PARTIES AGREE TO OPT-OUT OF THE APPLICABILITY OF MUCITA PURSUANT TO SECTION 22-104 OF THE COMMERCIAL LAW ARTCLE OF THE ANNOTATED CODE OF MARYLAND. You may continue to use alternative methods of communication for contacting your health care provider at any time, regardless of whether MyChart is available.

Kennedy Krieger takes no responsibility for, and disclaims liability from, any results or consequences from your intentional or unintentional sharing of, provision of access to, or disclosure of your username, password, activation code or medical record information available through MyChart.

Governing Law

These Terms of Use will be governed by Maryland law without giving effect to any choice of law rules or principles. You agree that Baltimore City, Maryland shall be the sole and exclusive venue for any legal action or proceeding between Kennedy Krieger and you for any purpose concerning these Terms of Use. Any cause of action or claim you may have with respect to Kennedy Krieger must be commenced within one (1) year after it arises, except to the extent such limitation is not enforceable. To the fullest extent permitted by law, each party to these Terms of Use waives his or her right to a jury trial with respect to any dispute or other controversy arising from hereunder or your use of or access to MyChart.
